1. Service Agreement
By creating a Bevurity Guest Account, you agree to these Terms of Service. Bevurity™ is a platform provided by Spencer D. J. Powell Hospitality & Services. The app allows you to discover venues, track your beverage history, and participate in loyalty programs.
2. Alcohol & Age Requirements
Bevurity is NOT an age-verification service.
- Legal Drinking Age: You agree that you will not use this app to attempt to purchase or claim alcoholic beverages unless you are of legal drinking age in your current jurisdiction (19+ in British Columbia).
- Venue Authority: The specific Venue reserves the absolute right to verify your age via physical identification at the point of service. A "Claim" or "Badge" in this app does not entitle you to service if you cannot produce valid ID or if you are intoxicated.
Responsible Consumption
Bevurity is a tool for discovery and appreciation, not over-consumption. Earning "Badges" or completing "Passports" should never be used as a reason to consume alcohol immoderately or unsafely. Always have a designated driver or use a ride-share service. Bevurity and its partner venues reserve the right to disable "Claim" functionality for any user suspected of abusing the platform.
3. Photo Uploads & User-Generated Content
Content License: By submitting a photo for a "Claim," you grant Bevurity and the associated Venue a perpetual, irrevocable, royalty-free license to display that photo within the platform and on external promotional channels (such as social media). You represent that you own the photo and that it does not contain the likeness of other people without their consent.
Removal: While you may request the deletion of your account, photos previously approved by a Venue may remain part of that Venue’s digital gallery in an anonymized state.
4. Code of Conduct
You agree not to submit false claims or offensive content. Fraudulent activity may result in the suspension of your account and the revocation of earned badges.
5. Disclaimer on Venue Data
Bevurity provides the platform, but Venues manage their own data. We are not liable for inaccurate pricing, ingredient lists, out-of-stock items, or allergen information. Always confirm details with your server at the physical venue.
6. Geographic Limitation & Governing Law
British Columbia Only: Bevurity is currently designed and supported solely for use within the province of British Columbia, Canada. If you access the service from outside BC, you do so at your own risk.
Governing Law: These terms are governed by the laws of British Columbia and the federal laws of Canada. Any legal disputes shall be submitted to the exclusive jurisdiction of the courts in Vancouver, BC.
7. Beta Status & Limitation of Liability
Beta Software: You acknowledge that Bevurity is currently in an "Open Beta" phase. The service is provided "AS IS." We do not guarantee that the app will be error-free, that the map data will be 100% accurate, or that the service will be uninterrupted.
Limitation of Liability: To the maximum extent permitted by law, Spencer D. J. Powell Hospitality & Services shall not be liable for any damages arising from your use of the app, including but not limited to: travel expenses incurred based on app data, disputes with venues, or the loss of any "Badges" or "Passport" history due to technical failure. Our total liability to you for any claim shall not exceed $10.00 CAD.

1. Information We Collect
To provide the Bevurity experience, we collect:
- Profile Data: Your name, email address, and profile photo.
- Activity Data: The venues you visit, drinks you claim, ratings you submit, login timestamps, and timestamps of your activity.
- Location Data: Your GPS location is used *only* when you tap "Locate Me" or submit a claim to verify you are physically at the venue. We do not track your background location history.
- Communication Data: We may send you transactional notifications (e.g., "Verification Successful" or "You earned a Badge") via in-app alerts or the email address associated with your account.
2. What Venues Can See
Bevurity™ is a platform designed to connect guests with venues. While we provide the infrastructure to facilitate these connections, the individual venues are separate legal entities.
- When you join: Venues do not see your personal contact info (email/phone) simply because you have an account.
- When you interact: If you "Claim" a drink or leave a "Rating," the specific Venue will see your Display Name and your Profile Photo associated with that transaction.
Third-Party Use: Once a photo is approved for display on a Venue's menu, Bevurity is no longer the sole controller of that specific image, as the Venue possesses a license to use it for their own promotional purposes. We are not responsible for the subsequent use of your public-facing information (Display Name, Profile Photo, Rating) by the Venue, provided such use remains within the bounds of our Business Terms of Service.
3. Third-Party Services
We utilize industry-standard sub-processors to power Bevurity:
- Google Firebase: Used for account authentication and secure data hosting.
- Google Maps/Places API: By using the "Explore" map or "Locate Me" features, you are also bound by the Google Privacy Policy.
4. Data Deletion
You have the right to be forgotten. If you wish to delete your account and all associated history, please contact support at cheers@bevurity.ca. Upon deletion, your personal identifiers will be scrubbed, though anonymized transaction data (e.g., "1 Margarita sold on March 15th") may be retained by the venue for inventory accuracy.
